Whereas, In response to the reduced availability of fuel, the United States Environmental Protection Agency (EPA) issued a temporary waiver of certain federal Reid vapor pressure (RVP) requirements to allow the production, distribution, and sale of gasoline at a common RVP standard of 9.0 psi, or 10.0 psi for certain ethanol blends; and
Whereas, The federal waiver took effect on May 1, 2026, and may be extended based on continued fuel supply constraints; and
Whereas, On April 2, 2026, Governor Whitmer declared a state of energy emergency across the state of Michigan in executive Order 2026-4, temporarily suspending MCL 290.650d and Regulation No. 561 to relax Michigan’s fuel requirements to the extent allowed by the federal waiver issued by the EPA; and
Whereas, Executive Order 2026-4 expires on July 1, 2026, and under current global conditions, resumed enforcement may constrain fuel supply and contribute to higher prices and reduced availability; and
Whereas, Pursuant to section 3 of the Declaration of State of Energy Emergency Act, 1982 PA 191, MCL 10.83, the legislature may approve an extension of a state of energy emergency for a specific number of days; and
Whereas, A 77-day extension of the state of energy emergency coincides with the potential for an extended federal waiver of federal RVP requirements based on continued fuel supply constraints; and
Whereas, If the legislature does not act to extend the state of energy emergency pursuant to MCL 10.83, the state of energy emergency will be terminated on July 1, 2026, risking fuel shortages and increased gas prices for consumers and businesses; and
Whereas, It is in the best interests of the state of Michigan to extend the duration of this state of energy emergency as a temporary and targeted step to help alleviate upward pressure on fuel prices; now, therefore, be it
Resolved by the Senate (the House of Representatives concurring), That we approve the extension of the state of energy emergency declared on April 2, 2026 until September 16, 2026; and be it further
Resolved, That this resolution does not take effect until July 1, 2026; and be it further
Resolved, That copies of this resolution be transmitted to Governor.
