(2) Any principal, interest and earnings deposited into the election administration support fund created under section 21-940 of article 21 and federal help America vote act funds, including any interest and earnings, in accordance with 52 U.S.C. 20901-21145 are appropriated for purposes described in this section. The department shall collaborate with other state departments, as appropriate, on the implementation of a uniform voting system and the state budget director is permitted to make the budgetary or accounting transactions necessary to authorize the utilization of these funds in the department or any collaborating department.

(3) The unexpended funds appropriated in part 1 for election equipment reserve fund and this section are designated as a work project appropriation, and any unencumbered or unallotted funds shall not lapse at the end of the fiscal year and shall be available for expenditures for projects under this section until the projects have been completed. The following is in compliance with section 451a of the management and budget act, 1984 PA 431, MCL 18.1451a:

(a) The purpose of the project is to support the purchase of election equipment for local units government.

(b) The project will be accomplished by utilizing state employees or contracts with service providers, or both.

(c) The total estimated cost of the project is $43,164,000.00.

(d) The tentative completion date is September 30, 2031.”.

(c) Each contractor shall validate that any subcontractors utilized within these appropriations share the same mission as the lead agency receiving funding.

(d) Each contractor or subcontractor shall demonstrate cost-effectiveness.

(e) Each contractor or subcontractor shall ensure their ability to leverage private dollars to strengthen and maximize service provision.

(f) Each contractor or subcontractor shall provide timely and accurate reports regarding the number of clients served, units of service provision, and ability to meet their stated goals.

(3) The department shall require each contractor described in subsection (1) to ensure that the funds appropriated in this section are only used on proven or established programs.

(4) The department shall require an annual report from the contractors described in subsection (2). The annual report, due 60 days following the end of the contract period, must include specific information on services and programs provided, the client base to which the services and programs were provided, information on any wraparound services provided, and the expenditures for those services. Not later than February 1 of the current fiscal year, the department must submit the annual reports to the standard report recipients.”.

The report shall include the workgroup’s findings and detailed recommendations for improving the existing PIHP system. These recommendations shall be based on the review described in subsection (1) and address, at a minimum, the factors outlined in that subsection, with the goal of creating a simplified and workable structure that strengthens behavioral health outcomes.

(4) The department shall not begin an RFP related to changes to the PIPH system until the workgroup’s work has concluded. The department shall not implement any substantive changes to the PIHP system or move forward with a new procurement process without the express approval of the legislature.

(5) The department shall not expend any funds for or related to contracting for services regarding any substantiative changes to the current PIHP system.”.

Development and implementation of medication distribution and dosing policies is to ensure safe medication administration and to minimize errors.

(2) The department shall develop and implement medication distribution and dosing policies including, but not limited to, all of the following:

(a) The use of two patient identifiers.

(b) Conducting independent double-checks for high-alert medications.

(c) Administering medications within a specific window to maintain therapeutic levels.

(d) Recording administration immediately after giving the medication, including the dose, route, site, and patient response.

(e) Ensuring medication is appropriate for treating the prisoner’s condition.

(f) Monitoring the prisoner for the desired effect and any adverse reactions.

(g) Allowing only authorized personnel to manage, store, and dispense medications, with in-house pharmacies serving as the primary control point.

(h) Storing medications in locked, secure, and organized areas that follow manufacturer temperature requirements.

(i) Using older stock first and conducting regular checks for expired or damaged items.

Sec. 723. (1) From the funds appropriated in part 1, the department shall ensure non-discriminatory, equitable access for all prisoners with physical or mental impairments that substantially limit major life activities. This includes impairments that are episodic or in remission.

(2) The department shall comply with the Americans with Disabilities Act of 1990 and the Persons with Disabilities Civil Rights Act, 1976 PA 220.

(3) The department shall assess accommodation needs of prisoners and provide reasonable accommodations. The department shall remove all communication and structural barriers to ensure equal access to services and prisoner programming.

(4) The department shall regularly evaluate policies and physical facilities to identify barriers. The department shall train all staff on ADA requirements for accommodating prisoners with disabilities.”.

(f) Data on the use of funding made available under the drunk driver jail reduction and community treatment program.

(2) The report required under subsection (1) must include the total funding allocated, program expenditures, required program data, and year-to-date totals.”.

(c) Each contractor shall validate that any subcontractors utilized within these appropriations share the same mission as the lead agency receiving funding.

(d) Each contractor or subcontractor shall demonstrate cost-effectiveness.

(e) Each contractor or subcontractor shall ensure their ability to leverage private dollars to strengthen and maximize service provision.

(f) Each contractor or subcontractor shall provide timely and accurate reports regarding the number of clients served, units of service provision, and ability to meet their stated goals.

(3) The department shall require each contractor described in subsection (1) to ensure that the funds appropriated in this section are only used on proven or established programs.

(4) The department shall require an annual report from the contractors described in subsection (2). The annual report, due 60 days following the end of the contract period, must include specific information on services and programs provided, the client base to which the services and programs were provided, information on any wraparound services provided, and the expenditures for those services. Not later than February 1 of the current fiscal year, the department must submit the annual reports to the standard report recipients.”.

(3) The department shall not implement policies that shift management of psychiatric inpatient benefits or related behavioral health services to Medicaid health plans unless specifically authorized by a subsequent act of the legislature.

(4) The department shall maintain the current structure of responsibility for behavioral health services unless otherwise directed by law.”.
