2019 House Bill 5030

Authorize automatic expungement of individuals’ marijuana records

Introduced in the House

Sept. 25, 2019

Introduced by Rep. Sheldon Neeley (D-34)

To automatically “set aside” possession and use violations of Michigan’s repealed marijuana prohibition law from individuals’ criminal history records as of Jan. 1, 2020. Individuals with marijuana trafficking convictions could apply for expungement, which courts would have to grant as long as the violation did not violate the state new recreational marijuana law; this would also apply to violations of the legal marijuana sales regulatory and licensure regime, if the violator was attempting in good faith to abide by those regulations and impositions.
