2019 House Bill 4520

Limit insurance agent liability

Introduced in the House

April 30, 2019

Introduced by Rep. Daire Rendon (R-103)

To limit the liability of insurance agents beyond exercising the “minimum skill and care, knowledge, and expertise” expected in placing or servicing policies and coverage of a given level of complexity. An agent who has not established a “special relationship” as defined in the bill would not be liable for things like “using a common phrase of puffery or assurance, such as full coverage, good coverage, or you are covered;” offering additional coverage options or limits; providing advice or an explanation about a specific issue in a dispute, and more.
