2009 Senate Bill 681

Repeal AIDS test consent requirement

Introduced in the Senate

July 15, 2009

Introduced by Sen. Tom George (R-20)

To repeal a provision of the state health code that prohibits a physician from ordering an HIV (AIDS) test without specific written consent of the test subject. A patient’s consent to “general medical care” would be considered to be consent to an AIDS test, unless the test is specifically declined.
