2008 Senate Bill 1468

Revise criminal record expungement rules

Introduced in the Senate

Sept. 10, 2008

Introduced

To revise the grounds for seeking to have a criminal record expunged from a person’s record. The bill would allow a person convicted of more than one felony offense to have these "set aside," or expunged from the person's public record, if the convictions arose from the same criminal act. This would not apply if more than one of the convictions is for a felony, or if the conviction is for an assautive crime, criminal sexual conduct, domestic violence, or crimes punishable by life imprisonment. Under current law, only a person with a single criminal conviction can petition to have the record expunged.
