To authorize up to 15 years in prison for injuring or causing death to a worker in a road construction zone, even if the underlying moving violation does not also have criminal penalties. Under current law, a driver who causes death or injury to a highway construction worker is not subject to imprisonment unless the traffic law violation which caused the tragedy also has criminal sanctions.

The substitute also tie-bars the bill to House Bill 5089, which defines the road work zones in which a driver is subject to the penalties amended by this bill.
