2020 Senate Bill 958

Revise state of emergency executive order process

Introduced in the Senate

June 4, 2020

Introduced by Sen. Kim LaSata (R-21)

To revise one of the two state laws that authorize a governor to declare a state of emergency and issue enforceable executive orders (Public Act 302 of 1945). The bill would require that when issuing executive orders the governor must first “…consider how different counties in this state will be affected and shall consult with public officials and community leaders in each” before issuing the order. Also, if an executive order included a stay-at-home order, a county could petition for an exemption if it details in the petition how it will protect public health there.
