2019 House Bill 4033

Compel public employees to pay union fees

Introduced in the House

Jan. 15, 2019

Introduced by Rep. John Chirkun (D-22)

To allow public employee unions that organize workers in government and public school workplaces, and those workers' employers, to enter contracts that impose a union “service fee” on all employees, even if an individual does not wish to financially support the union. The bill appears to violate the U.S. Supreme Court’s June 2018 ruling in Janus v. AFSCME, which held that compelling government employees to pay dues or fees violates their civil rights under the 1st Amendment’s freedom of speech and freedom of association provisions. It would also reverse the provisions of Michigan’s right to work law for public employees.
