Cap hospital and doctor charges for treating car crash injuries, allow more lawsuits

To cap the amounts charged by hospitals and health care professionals that treat and provide rehab for injuries sustained in vehicle crashes. The bill would cap rates at a percentage of the amount allowed for workers compensation cases under a different law. Emergency trauma treatment charges would not be capped. Also, to allow a person to claim that an auto insurer has not dealt "fairly and in good faith" and on this basis sue for compensatory, consequential, and exemplary (punitive) damages, notwithstanding the prohibition on punitive damages in other areas of Michigan tort law. This is part of a package comprised of House Bills 5101 to 5111.
