2013 House Bill 4839

Revise expunged crime disclosure restriction

Introduced in the House

June 13, 2013

Introduced by Rep. Tom Leonard (R-93)

To revise a confidentiality provision in the law allowing a court to “set aside” (expunge) a comparatively minor criminal conviction, meaning that no public record of the conviction is available (but it remains in restricted State Police records). Under current law, it is a misdemeanor for anyone except the violator to divulge or publish a “set aside” conviction. The bill would also include the crime victim in this exception.
