2011 House Bill 5076: Revise local government budget lawsuit standing and authority
Introduced by Rep. Peter Pettalia R-Presque Isle on October 13, 2011
To establish that only the chief administrative officer of a local government has standing to sue the municipality for passing a budget that doesn’t adequately fund activities required by law; and also establish that the only the a local government’s legislative body can sue the chief administrative officer for failure to properly administer, execute and enforce the budget. However, a court funded by the municipal government could sue for more money, but any hearings would have to consider the ability of the local government to pay more.   Official Text and Analysis.
