2018 House Bill 5816

Increase government liability for pothole damage

Introduced in the House

April 17, 2018

Introduced by Rep. Patrick Green (D-28)

To revise a law that makes government agencies liable for damage caused to vehicles by road defects that they knew or should have known exist. The bill would establish that for potholes, government liability kicks-in seven days after the pothole became “readily apparent to an ordinarily observant person.” In other words, the bill creates a presumption that the hole should have been filled in that time.
