2009 House Joint Resolution P

Mandate Supreme Court justice recusal for certain factors

Introduced in the House

March 11, 2009

Introduced by Rep. Mark Meadows (D-69)

To place before voters in the next general election a Constitutional amendment to establish specific criteria that would require a Supreme Court justice to “recuse” himself or herself from judging a case. These include such things as having an animus to a particular attorney arguing a case, the justice (or a family member) having a financial interest or relationship with one of the parties, having made public statements appearing to commit the justice to a particular result in a case, the existence of related cases in which the justice may be a material witness, and more.
