2008 House Bill 6455 / Public Act 460

Authorize “bad driver fees” installment plans

Introduced in the House

Sept. 11, 2008

Introduced by Rep. Fred Miller (D-31)

To expand the installment payment plan provisions for individuals subject to the “driver responsibility fees” (“bad driver fees”) that are assessed for various violations and must be paid for two consecutive years. These very expensive fees were originally adopted in 2003 to raise revenue so as avoid spending cuts in that year’s and subsequent state government budgets. The bill would allow an individual whose license has already been suspendeed to be granted an installment plan.

Referred to the Committee on Transportation

Sept. 25, 2008

Reported without amendment

With the recommendation that the substitute (H-1) be adopted and that the bill then pass.

Substitute offered

To replace the previous version of the bill with one that would allow installment plans on amounts less than $500 and spread up to 24 months.

The bill would allow an individual whose license has already been suspendeed to get their license back after arranging an installment plan, and allow installments on amounts less than the current threshold of $500, spread out over 24 months or less (vs. 12 months under current law). Note: A $125 license reinstatement fee is also required, and could be included in the installment plan.
