2007 House Bill 5246

Revise tipped employee minimum wage provisions

Introduced in the House

Sept. 19, 2007

Introduced by Rep. LaMar Lemmons (D-2)

To repeal the tipped employees provisions in the law that makes it unlawful to pay less than $7.15 to an hourly employee, notwithstanding any voluntary agreement between the employer and employee. Under current “minimum wage” law, the mandated pay is the same for tipped employees, but the employer must pay at least $2.65 of the amount, with the balance coming from tips. If the tips plus the $2.65 do not add up to $7.15, the employer must make up the difference. This would be repealed, and the employer would have to pay the full $7.15 regardless of the tips.
