2001 House Bill 4546

To prohibit a person with a domestic violence history from being granted custody in child custody cases if that domestic violence occurred against the other person filing for custody, unless it was in the best interests of the child and there existed no significant risk of future domestic violence. The bill also requires the court to favor the person less likely to continue perpetrating domestic violence if both parties have a history of domestic violence against each other.
