2011 House Bill 5110 (Revise criteria for investigatory stops of moving vessels )

Introduced in the House on October 19, 2011, to revise the criteria for investigatory stops of moving vessels. The bill would allow stops not just for suspicion that the vessel is violating a marine law, but also for suspected engagement “in criminal activity,” and allow an immediate arrest if this is found, without having to get an arrest warrant

The vote was 98 in favor, 7 opposed and 4 not voting

(House Roll Call 496 at House Journal 0)

More evidence the republicans are really not who the tea baggers thought they were. They are the party of big brother.

This bill has NOTHING to do with Big Government as one of the liberal posters has stated but is about being able to control and defend our great lakes from illegal immigration, weapns of mass destruction and drugs entering our lakes and ports.  Anyone who doesn't fundamentally support this bill seems to have their head on backwards or wants ill will placed upon our state and waterways!

This bill, as described, states nothing about probable cause.  Does "Suspecting" something constitute probable cause?  It appears that the supporters of this bill do not realize that, for many people, their boat is their home and for even more people their boat is their weekend home.  Does this bill give any specific recognition to the legality of the Fourth Amendment?
