    2008 Senate Bill 1596 (Revise workers comp detail for out-of-state injuries )

    Introduced in the Senate on November 6, 2008, to establish that the Michigan worker's compensation bureau has exclusive jurisdiction over and coverage for out-of-state injuries incurred by a Michigan resident working for a Michigan employer

    The vote was 36 in favor, 0 opposed and 2 not voting

     I'd like to thank Sentor Jason Allen for having the insight, and for understanding the ramifications, that apparently the big six, of the State Supreme Court didn't, couldn't or woudn't...I, Phillip,and my wife Barbara Walker were affected while receiving workers compensation from the State of Michigan steming from a horrific 18 wheeler accident while working for a Michigan base trucking company,but residing here in the state of  Ohio..At first we were'nt sure as to why our benefits were challenged, disputed and then  denied. And then we received the letter from our Lawyers telling of the new law, MCL 418.845..Certainly this would apply to only new recipiants who's workers compensation insurance fund were being paid into their respective State of resident, we thought, but that makes to much sense, or cents, depending on the beneficuaries.. Our lawyers made it very clear, common sense does'nt apply hear, only dollars and cents, and so none, and we mean absolutly none of our benefits from that date foward, were paid, not even before that date, the abulance that scaped us off the ground from a 70 mph accident in Marshall MO. to our breif hospital stay there as well as, Infact on 9/11/05 just 2 months before the company disputed, the open heart surgery I had to have, as a result my injuries sustained in the accident, or my wife's injuries which are more emotional as well as physical..Our lawyers said there is nothing to dispute, because it is as if "we've never had a claim as far as the State of Michigan is concern". Now I'm not the brightest crayon in the box, but workers compensation is for the protection of the company,as well as having a cap on the amounts they're liable for, but since the Supreme Courts has imunity, it was granted to the companies as well?..Talk about the perfect crime..Or was it? Considering Katrina and scores of other insurance fraud by large entities and "issues of responsability" peoples homes, and lives are not considered as part of the bottom line! American companies are now following the lead of our big brother and our uncle ,,Uncle Sam,, shame on you,, and more so shame on us for allowing it...Being in good hands, or like a good neighbor, use to be a comfortingthought, but now it's about profit, when it should be about prophet, at least that's what I believe the Founding Fathers had in mind, a Prophetic Vision, not a pathetic decision..One has come to pass on January 20th 2009, the other well, all I can say again is "Thank You Senetor Jason Allen for correcting the injustice that has affected "just us" the poor working class citizens that don't happend to live in Michigan.....PS maybe it was the Cleveland Bowns fault... lol
