    2008 Senate Bill 1388 (Revise DNA database rules )

    Introduced in the Senate on June 17, 2008, to revise the law that requires state law enforcement agencies to destroy DNA samples taken from individuals who are arrested but not convicted (with some exceptions). The bill would establish that a conviction based on a DNA sample that was erroneously obtained or retained would not be reversible on that basis

    The vote was 36 in favor, 0 opposed and 2 not voting

    "The bill would establish that a conviction based on a DNA sample that was erroneously obtained or retained would not be reversible on that basis" Why even have the law that makes the state destoy it in the first place? You can bet that if there is no reason for the state to destroy it then they won't.
