    2007 Senate Bill 540 (Revise trespassing definition )

    Introduced in the Senate on May 25, 2007, to revise the definition of trespassing so as to prohibit a person from entering or remaining on another person's farm property without permission or lawful authority (as opposed to "willfully" doing so), and specifying that the owner need not request the person to leave for it to be a violation. It would not be violation if a person is in the process of attempting by the most direct route to contact the owner or his agent to request consent. The bill would also increase the maximum fine for trespassing from $50 to $250

    Get a Grip

    This is a bunch of scrap. I have to kick hunters off my property all the time, and it is posted No Hunting or Trasspassing. All a trasspaser would have to save if caught is. Hay Thanks to Sen. Ron Jelinek I was just coming to see you about that sign, as soon as I gut this deer.

    If a property is posted "No Hunting" or "No Trespassing" isn't that the answer to the request?

    A "no trespassing" sign may be, but definitely is not necessarily the final answer to a request to enter. Many of us have been permitted access to posted property by introducing ourselves to and communicating with the owners. This proposal only reflects common sense. That should make it entirely unnecessary.

    PERMISSION to enter? trespassers are on property WITHOUT THE OWNER'S PERMISSION. hunters are on land WITH the owner's permission, and if they are polite, and ethical hunters, they have the land owner's BLESSINGS AS WELL. if they are rude, unethical, and SLOB HUNTERS, then they become TRESPASSERS. i currently enjoy the permission AND blessings of several land owners in several states. they appreciate the fact that i ALWAYS OFFER to share my take with them. they appreciate that i ALWAYS ASK PERMISSION to go on their land, even though i have KEYS to the gates. they appreciate that i always ask about trophy animals before i shoot them, this allows them to make the decision whether or not to take these animals themselves. i always get the same answer, "if you see it and it looks good, take it." they appreciate that i always let them know if i see any other hunters on the property. this lets them know i care about their permission and that i don't support trespassing. they also appreciate that i bring my wife and children hunting with me, teaching them about safety and responsibility. they enjoy the chance to pass on their wisdom and experiences to me and my wife and children. most have become 'un-official aunts and uncles'. if we treat the land owner with respect, he will allow us to hunt his land as if it were our own. if we DO NOT treat the land owner with respect, he will treat us as trespassers.

    I said exactly what I meant to say, and do not need your verbose help. The "no trespassing" or "no hunting" sign may be the final word, or it may not be. The proof of that is that many of us have gained permission to enter posted property simply by communicating with the owner or manager of it, in person. That has meant entering the property and knocking on a door in most cases. This proposal would exempt from trespassing charges those who seek to knock on a door to ask permission . It merely is common sense. A law to impose this should be quite unnecessary.

    is already quite unnecessary. tresspassing is a crime ONLY if you don't have the owner's permission to enter the property. no sign, or fence can change that. either you have permission or you don't. simply being ON the land is NOT TRESPASSING. it's NOT trespassing until it has been determined that the person on the property DOESN'T HAVE PERMISSION TO BE THERE. it's been a part of common law for hundreds of years, why change it now???

    well, according to the law AS IT IS NOW, the guy has poached and trespassed. both harm you. i wonder why the good legislator would want to give a CRIMINAL a big loophole to crawl through? maybe she'd like to log on and answer that question, i'm pretty sure that she reads this site to keep her finger on the 'pulse' of the people. if not, maybe she should.

    Trespassing!

    What rights does a land owner have in regards to neighbors continuing to trespass after being told not to and the land has been posted for years? They are also trespassing with a vehicle (4-wheeler A.T.V.). They are hunting without permission. What are the land owners rights in regards to confiscation on vehicles, firearms, and detainment until police arrive. What is the full extent of the law that can be applied here?

    This law doesn't do much for land owners rights. We need stiffer penalties and MUCH better enforcement.

    NO RIGHTS

    I was informed that I have virtually no rights by a cop. I had a hunter who has been crossing my land tell my wife he bought "doggie mace" to protect himself from my dog. So to make his day difficult I beat on a garbage can while patroling my land and fired off a few 20 ga. rounds. THE POLICE CAME TO MY HOUSE AND TOLD ME THE LAND OWNER I WAS IN VIOLATION OF HUNTER HARASSMENT LAWS. WELCOME TO THE NEW WORLD ORDER.

    You ain't seen noting yet. Wait till the obots get theri way. You will have to turn over your land because you are evil and have more stuff than the wino in the street. The obots will fix this by taking your stuff and giving it to the slackers.

    Asa hunter /a female hunter ,my family has experienced anti- hunters, we have 40 acres to hunt on, and we dont tresspass, but yet were harassed buy some b---- on a 4 wheeler threating to call the police,telling us they feed the deer,REALLY NOW!!!!!!!!!!!11HUH do they know their in violatiion of the NO BAIT/NO FEED THE DEER LAW IN MICHIGAN,Get a grip people,and were responsable hunters,we dont even field dress until we get back home,you people need to get a life,with out hunters all animals would be diseased and die off or starve,then you wouldnt have anything to watch!!!!and if my deer did run on your property,i would come to your door and ask for permission to search for it,and hopefully you would let us so the animal would rot on your property or have other vermin on your property such as coyotes that could or would harm some of your animals/pets,so give us a break were not all bad,
