Anyone who thinks that this legislation (at least as currently drafted) is a good idea should review the recent decisions from the bankruptcy courts in this state. These courts have expressed difficulty in determining when mortgages are deemed "recorded" because county register of deeds are not maintaining the statutorily mandated "enty books".
Importantly, repealing MCL 565.24 (thereby eliminating the requirement regarding entry books)without amending MCL 565.25 would create more problems than this bill is (presumabily) attempting to solve.
