2011 House Bill 5086: Ban government sending payroll PAC money to union (Senate Roll Call 72)

Passed 26 to 12 in the Senate on February 14, 2012, to prohibit the state, school districts and local governments from deducting money from an employee’s paycheck and contributing it to a union Political Action Committee (PAC). The bill would grant residents the right to sue for violations.

 Why do it?  Because this is one of the things payroll departments do in this country.  They set up automatic deductons for credit union/bank deposits, loan payments, United Way contributons,  wage garnishments, child support, IRS levies, union initiation fees, union dues, and so on.  But they don't care about these deductions.  These don't bother them at all.


So, let's call it what it is.  This is a republican controlled legislature sending bills to a republican governor and this involves unionized employees that decided to have a deduction of a dollar amount of their choosing, sent to a Political Action Committee.  Since members of unions are traditionally Democratic supporters, this republican legislature is saying, "Yep, THIS is where we draw the line.  "WE" will not condone or participate in any fundraising for the Democrats."


So, you're right.  Maybe we shouldn't have payroll staff enter ANY of these personal- choice deductions for ANY public employee.  They can all write checks to the United Fund, drop their deposit off at the bank, etc. 


But when the legislature selects one specific deduction to prohibit, it's discriminatory.  Automatic payroll deductions aren't illegal, and contributions to PACS aren't illegal, but payroll deductions of PAC contributions are (or soon will be) illegal. 


It's not only discriminatory, but it's a clear example of elected officials using their power and position to benefit themselves with no thought or concern for the citizens' needs or desires.   I'd love to see what the AG says about this peice of crap legislation, or better yet, watch the Supreme Court try to squirm around it.

This only makes sense.  Why should we have taxpayer fed payroll staff
making deductions from union public employee paychecks to fund PAC's?  
Let the public employee who is in a union take the responsibility to
personally decide to write a check themselves to a union PAC.
