2009 House Bill 5463

Retain wetland regulation at state level

Introduced in the House

Sept. 23, 2009

Introduced by Rep. Dan Scripps (D-101)

To not return the wetland regulation permit program to the federal government, as proposed by Gov. Jennifer Granholm as a cost saving measure. Michigan is one of just two states that have been delegated by Washington to manage and enforce federal wetland regulations. The bill would make various revisions to the way the regulations are administered, among other things establishing different procedures for permits for projects on “minor wetlands” and “exceptional wetlands,” authorizing more "general permits" that do not require site visits by state officials, requiring the use of federal wetland delineation standards, and more. The bill would also include provisions to facilitate cranberry bog cultivation within the constraints of these regulations.
