2011 Senate Bill 404

Strengthen Medicaid estate recovery procedures

Introduced in the Senate

June 7, 2011

Introduced by Sen. Roger Kahn (R-32)

To revise details of a Medicaid estate recovery program, in which the cost of nursing home and other care for Medicaid recipients may be recovered from the person’s estate after death. Among other things the bill would authorize state liens against a recipient’s property, and potentially a longer “look back” period for legal schemes used to shelter assets from this process. The bill would also authorize the Department of Community Health or its agent to negotiate deals with decedents’ spouses or heirs.
