Introduced by Sen. Dennis Olshove (D) on January 28, 2009, to establish that while a physician has no affirmative obligation to report to the Secretary of State or warn third parties regarding any concerns about person's mental and physical qualifications to safely operate a motor vehicle, he or she may do so, and in such a report should recommend a license suspension of six months or more. The bill establishes that the physician has no liability for either making or not making such a report.

If a doctor feels a person, in their clinical judgement, is endangering themselves and/or others by getting behind the wheel of a car I would HOPE they would report it! Otherwise It may be me or my loved ones that they are treating in the Emergency room. I think nurses should be included in this, they usually spend much more time with the patients. Of course they should be protected from prosecution for doing this, otherwise who in their right mind would report?
