2009 House Bill 4318: Ban inaccurate drug or herbal product representations

How can you diminish a man's life to "frivolous"?  How dare you reduce his or her importance to their family and as a contributing member of the community!!!  Whose lives have been diminished or lost because of a drug company's profit margin?   How cruel and heartless are your words. 


We aren't ignorant. 


Any company that can afford to spend more than 5 MILLION dollars in advertisement in one year for ONE drug really should take a better look at the image that projects.   Any company that has over 43 BILLION, that's Billion dollars, to purchase another company can't very well cry about not having enough money to research new drugs.  What happened to post marketing reporting to the FDA?  70% of all drugs, especially those with dangerous side effects, aren't reported back to the FDA.  


While we're on the subject of side effects I think it needs to be pointed out that side effects and allergic reactions are not the same.  Most allergic reactions seem to have universal symptoms.  Such as hives, sweating, trouble breathing, and vomiting.  If the manufactures don't report side effects to the FDA and vary from drug to drug how on earth do we know when we're suffering from one?  .  


As in the horrific out come of adolescents and young adults being prescribed Paxil, accountability might have allowed many young people to lead productive normal lives and even have saved lives.  It is a well known fact that Lilly knew as early as 1987 that Paxil caused teenagers and young adults toward suicidal tendencies.  In 1992 ABC News broke the story to the American public, not Lilly.  In those 5 years how many young lives were lost?  How many families destroyed because the sales reps were directed to promote Paxil with the utmost efficacy and with safety when prescribed for  the treatment of depression for these young people?   For those who attempted suicide or reported having suicidal thoughts have now been labeled, for life, has having a mental illness.  Because of this drug they are denied the honor of entering the arm services,to become teachers, police officers, and will carry this stigma with them until the day they die.


We have mothers, fathers, brothers, and sisters in places like Iraq and Afghanistan willing to die to protect our constitutional rights and our American way of life.  Our elected officials took an oath to protect our well being and the US Constitution and its Bill of Rights. Those elected officials that deny us of a fundamental right should be ashamed of themselves.


No matter what some may have you believe, Michigan is the only state that has this law.  The "exceptions" don't exist be cause you need to find someone willing to go to federal prison for wrong doing.  It's called "A case with in a case" and one has never been proven.


Give us back our American rights.  Give us back our voices and let us speak to those who were intended to make rulings on such matters. Let us speak for those who can no longer speak for themselves.

Statements by Reps. Hildenbrand and Haines,


“Mr. Speaker and members of the House:



Under current Michigan law, lawsuits against pharmaceutical drug makers
are prohibited if the drug was deemed safe by the United States Food
and Drug Administration.



I oppose this bill to change the law because it includes a provision
making the change retroactive, which punishes law-abiding businesses
for doing nothing more than following the law that the Legislature
passed. Punishing someone for something that was legal at they time
they did it is not only unfair, it will also set a chilling and
dangerous precedent that will discourage job providers from investing
in our state.



I am also concerned about what this change will do to the skyrocketing
cost of health care. Pharmaceutical drugs undergo rigorous clinical
testing and review by the Food and Drug Administration to ensure that
medications are as safe as possible. But it is impossible to make a
drug that is 100 percent safe. Ending the FDA defense would invite a
flood of new lawsuits from personal injury lawyers interested solely in
bilking drug companies - not protecting Michigan residents.



Prescription drugs are helping millions of people to enjoy healthier
longer lives. But our ability to research and develop new drugs will be
seriously diminished if we allow frivolous lawsuits against drug
manufacturers, and the cost of life-saving medicine will rise.”
