Introduced by Sen. Mark Schauer (D) on March 18, 2008, to prohibit an employer from recruiting, hiring, employing, or referring an illegal alien for employment, subject to a civil fine of $5,000, or the difference between what the alien was paid and what a legal worker at the median compensation for the job would have made, whichever is greater. An employer who checked an employee’s documents and confirmed legal status through an online federal government database would be immune.
