so a couple of weeks ago i was with my younger sister & a bunch of her friends, we were all in this old gun range that is shut down which is also on privet property. we were having a bonfire & most everyone was drinking, I'm 21 & their all under the legal drinking age (besides for a guy that showed up right when the police came). i was not the supplier, i actually do not know where they got the alcohol from, I'm sure it was through someone who they knew that was old enough or through some idiot that sold it to them cause they don't care about the law just the money. well the police had showed up, gave everyone besides for me & the other adult breathalyzers, most everyone besides us & three other people got taken to the police station. i just got notice that I'm being charged for "not telling a minor to quite drinking". i don't understand how their able to charge me with something like that, how much of an impact would it have on them if i was to say "HEY! you know, you guys really should stop drinking, yet I'm going to sit here & drink along the side of you". yes, a very very very bad choice on my end but i knew nothing was going to stop these kids from doing what they went there to do. since this is a "free" country that is restricted by some ridiculous laws since I'm getting in trouble for someone else's choices. I'm just absolutely baffled by this. is it real? can i really be charged with something of the sorts? any information would be very useful.

i lost my job and did't work but supported myself with my 401k for a while payed my first year of fees was told i could not pay both years at the same time. one year later no money left in 401k license now suspended for not paying fees got pulled over 4/08/08 for driveing on a bad plate endup going to jail the impound on my truck was $155 my mom payed for the ploice put a hold on it for insurance and plate so my mom payed for this to.tryed to look for a job got a couple of calls but as soon as i tell them i don't have a license thay hang up on me.plus this volation of amendments to the constitution(the bill of rights) amendment 5,8 at very least and if you have ever been to court you whould here the judge will tell you law prohibits you to being fine more than $500.00 i guess this is what ben franklin was saying government was created by a bunch of genus so it could be run by a bunch of idots

Did you know Michigan court houses are running out of money and are being run by some people of the mob. In order to save the court house they have to raise money. The best way is to run rackets on the NORMAL CITIZANS who don't know whats up. Heres how it works, First they have to do it and get away with it. Legalized by public act. Dirty cops find suspects Gulty or not it doesn't matter. Collect DRIVERS RESPONSABILITY FEES. Next they have a maximum amount of time before they have to give the money to the state. So they use every bit of it they can. How, Now they hold the money in a bank acount to collect the intrest of it. When it comes time for the state to collect they simply give up the money and keep what they made from the intrest. Save ther job, save the courthouse, pocket the money for themselfs, In the process screwing us. It's not our fault the St. Josph, Michigan Court house is run by the BLOODS or crips "WHAT EVER". How about I get my money back and the intrest, or you can learn how to run your own court house. Whats really exiting is they'er not just blacks and young people there's old people too.

It's 11:15 am, March 21. At least two TV stations are at the state Capitol looking for the "bad driver fee" protest demonstration. Presumably they are snarking that no one showed because the victims couldn't drive there.

1)The citizens of Michigan only need a part time unicameral form of state government. We do not need republicans or democrates at the state level we need representatives who are going to do whats in the best interests of the people.

2)A ballot initiative to get unemployement to mean everyone in the state who is unemployed or underemployed and not just mean those that are recieving unemployment insurance aid. Then we would see the real unemployment rate in the high teens or low twenties.

3)Repeal of the driver's repsonsibility law. This one looks like it has already occured.

4)We need to enact a law that imposes a tax on foreign cars to equal what they have stolen from our standard of living, so foreign car tags should cost between 6K-9K to cover loss of jobs, health care and loss of tax revenue.

Citizens of Michigan each of us has the reponsibility to do something to take this state back from the feds and our state officials until we can get them out. Do not wait for any government official to do anything for you. Trade Policy starts with each of us, if we don't buy then the cheap crap doesn't come in. Also, voting for the same people over and over again and expecting the same result I think is the definition of insanity. The state should purchase the book by Richard Florida entitled "The rise of the creative class" http://www.creativeclass.com to see why anyone who can get out of this state leaves and doesn't look back!

Mr. Caswell, I would like to thank you for reversing a law which should never have been instituted in the first place, to put it bluntly was everyone asleep at the wheel when this was passed? I moved to Atlanta Georgia in 1998 and just came back full time about a year ago. When I first came back I couldn't believe it, the entire state had gone to H___, and we now had a Canadian govenor. There are many observations that I could go into but suffice it to say that living in this state now compared to when I left is one continuous hassle after another. Its no wonder that the best and the brightest (all of my friends) have left the state and the only ones left are the 90 percent who can't get out, and the few that have businesses or family obligations here and of course a state government who is feeding at the trough while they still can although I haven't seen much evidence of any leadership but mostly talk and arguments between the Republicans and Democrates I guess in order to live up to a false reality that a couple of hundred citizens who still can be mind controlled into thinking that there is acutally any difference between them as if there ever was. I first learned of this "Driver Responsibility" act when I went a couple of weeks ago to renew my license and was told that I could not because there was an "issue" with the state of Ohio and it was at this time that I learned that against the majority wishes of the citizens of this state that our government officials have fed us to the federal lambs and joined the "Real ID" act anyway. I was told that my Ohio drivers license needed to be reinstated for 425 dollars by the state of Ohio department of motor vehicles but the funny thing is that I have never resided in Ohio nor had I ever applied for an Ohio drivers license and yet I had one complete with a MI address? How could this be possible. So, because this act which was only passed to make money because there isn't anyone in the state leadership that can read the book by Richard Florida called "The rise of the creative class" nor is there anyone creative enough to spur new industries because simply put its so much easier to pass new taxes and fees to the remaining population and get as much money from them before they too one day wake up and pack the U-Haul to leave to get away from this State's nonsense when there are so many other States that gets what it means to reign in spending, and cater to the lucrative creative class. So, there I was in the MI secretary of state office and basically my state had left me to the whims of the 49 other states and the feds to fend for myself nevermind that other states have laws that our Supreme Court has struck down as unconstitutional but yet the same state enforces those laws if a citizen is entrapped in another state and given a ticket by using the unconstitutional laws or perhaps some of the states that still to this day have rampant police corruption such as for many years the police in the State of Georgia who looked at Michiganders as easy prey even if they weren't speeded because Michiganders would pay cash and get on their way to Florida and hence the reason we were for many years a non reciprocal information sharing state. Yes my state has left me without a valid drivers license but I don't need one to drive my car it still drives the same either expired or renewed. I then had to hire a lawyer to investigate this and as of today looks like I have had my identity stolen. I don't agree with the act as it does nothing to make anyone a better driver, heck I also found out that one doesn't even have to take a written test anymore which explains the state of affairs with the drivers I have encountered and observed since I have moved back from Georgia. I then started asking friends and other peers about this act and I heard nothing but foul language and then was educated how many of them were paying 250 or more just to have their Drivers License made legal. It also explained the many people who I have met who are all driving around with expired drivers licenses and i couldn't understand why they were but now I totally understand. If one doesn't have the money to pay the ransom to another state to get their license and it usually is in the hundreds if not thoughsands esily then people just drive around illegally because either they don't have the money, the knowledge or drive to get through the maze of the state procedures or simply don't know where to go or who to contact and of course the state doen't offer any free legal aid for these people. I really have to ask is this the type of citizen Lansing wants? The poor and downtrodden who don't have the money or drive to get all of paperwork done to get another state to release there liscense so they drive around in fear looking at all of what has become a swarm of cop cars everywhere since I hve moved back. I spoke to a guy from Arkansas who emailed me and told me that he had moved here two years ago and could not wait till his company transfered him out of here because of this and many other similar policies all designed to make the state more money. I could go into further detail but need to stop. I already had enough volunteers in the Detroit area to stand outside of secretary of state offices and get signatures for a ballot initiative that would repeal this law. Bottom line, Lansing needs to wake up and study other states which are having successes that attract people to their states anddoesn't spur its citizens to leave.

I totally agree with this post and not this legislation. I also pay child support, and this law has rendered me "HELPLESS"! I got caught driving to work in my car that was registered but not insured. Big deal. I drive to work and home so I can pay my child support and stay out of jail. As a result, I kmow have looming over my head on top of everything else two $500 fees plus the registration and re-reinstatement fee. Holy Crap! Not to mention insurance. Where will it end? I have a hypothesis. We all hve friends that have left the state, and I see no end in sight. So when they (THE STATE of MICHIGAN)have suck every last penny out of the "LITTLE GUY" and there are alot of us in the same position, the state will not have any more revenue to extort! Then what? Will this become a communist state with bread lines?

i allready payed 3000 spent 60 days in jail payed 2700 in probation 30 a day to stay in jail. i know i deserved most of this the night in 03 i was in an accident with my ex she was trashed blacked out i was honestly quite sober and she wouldnt take no for an answer to get her and her friend hom,e we were at my friends of like 10 years and was with friends i knew for 15 years or so she was spiting at nme and swearing and screaming she was such a mess after a while she was at the point where i could only understand a word or 2 out of 15 20 in the car she fliped out again and went nuts had her back up against the doorkicking with her whole body and she was like 5 ft 9 all legs and got me in the face and i hit a phone poll the cops booked me and let me out on no bond. she was at the hospital she was OK the cops droped me off where she was. not 10 minutes after i was there they told her she was pregnant i was happy but scared. she just started crying. she knew i was going to jail for a lil bit she knew i wouldnt be driving for the next half decade i tryed to find a job close to her school cause cheap apartments are allways near colleges also it would save money in gas and things loike that the area had everything within a few miles school, stores hospital ha dfamily near to help if i had to work and she had school. but she knew without me driving i would stay in school or find a good job i would be cooking for 8-9 an hour and she was right i havent made any money in 2 years. she didnt want the kid i went to jail i explained all this to the judge. im shure he heres that every day im not special. im not a bad person and i would have not taken anythoing for granted he he gave me a lil break. i havent touched a drink sence 2003. i look for work now ionly 2 3 days a week. cant get hired anywhere they do a backround chgeck. but while i was in jail she had an abortion but not before she dumped me she didnt tell me about the kid untill after i got out. after that she destroyed her self with drugs and she died. i wasnt going to post the beginning i worte the rest b 4 what i just wrote its out of order . i passed the all sobriety tests blew a .08 and this is what happened. this was in 2003 i can try to get my lisense back 08-08 so 5 years w/o i had to quit school i lost my lease and am making hardly any money actually i am not making anything. i lost my license at 18 when i was stupid, then again when i was 23 also very stupid. loseing my license so young the first tiume i would have been able to bounce back if i wasnt a mess at the time i got it back. i joined the air force in 2001 i left for lackland afb on sept 25 2001. was home on October 28 2001, i was doing my 2 and a half mile run and my fingers and lips turned purple and turned numb, the doctor said i had a mummer so i was not in a good place i joined because i wanted to do something that mattered and at the same time get out of debt i was up to 25000 by age 22it is scary oweing that much money exspecally without many skills just some college credits in a time where a associates or ba is nothing when everyone seems to have an associates in something. the manager at subway has an associates in business. i have friends who have masters and one even a dr and the 1 with the dr is the only 1 to find a job in what he went to school for. one has and also saw it as a way to . i can only work for a place close enough for me to walk. my life kinda sucks but maybe i deserve some of it i dont know. all this is all true and i did learn my lesson it took alot but i have. but i payed enough for my bad judgement and you say boo hoo i know you have skeletons every one does your just so smug and i bet your closet is full of them hence they holier than attitude

I am very discouraged, I received a DUI and I wasn't even drinking or under the influence of anything. I moved to Dearborn Michigan and I can home one night and the police (my neighbors around the block who are officers) stopped me while I was walking up my driveway. Melissa Krot said that I ran a stop sign on a street I was never on and then arrested me for dui and gave me 8 other tickets, I was then told that Niggers was not allowed in Dearborn.

I was not given any test until we got to the station I passed the Breath test twice with 00% but she still charged me with OUIL. She lied in the police report and then claimed that I refused to take the test which I didn't so they took my license. During this whole time I had no defense the judge took her word for it and put me in jail. I had a clean record totally clean never had a ticket in my life not even a parking tickets. But all of a sudden I move to Dearborn Michigan and became a Person who drinks and drives, speeds, runs stop signs all in one night. Well the way these laws are set-up allows for abuse to take place, Since then I lost my insurance, I lost my job, I can't get hired anywhere, I had to move, All because of racist cops and a legal system that don't allow you to defend yourself against the charges. Not only that they lied at the secretary of state hearing and I lost my license for a year and now I have to pay Drivers responsibility. I hate Michigan for being such a unfair state, I plan on moving as soon as I can because M.A.D.D has a huge grip on the politics in this state. And the worst part about it is that I just happen to get harassed by some racist cops and they had the power to take everything from me. And also a DUI stays on your record for life in Michigan you cannot get it removed so Im screwed forever. I could not believe it and I didn't do anything thats whats frustrates me the most.

My family has been repeatedly screwed over by lying cops. I'm not saying that all lie, but when a friend of mine who IS a state trooper says that they are abusing their power, what else is there to say. They lie because they can, they lie for the overtime pay, they lie to cover their own a$$, all because they know that they jaded, and disgruntled judges that are sick and tired of dealing with traffic violations will just agree and refuse to hear any retort from the citizen. Thus, those of us without the "I'm better than you" badge are just screwed.

Michael Dickerson "seeing you like posting my name all over this site" you need to stop lying and take responsibility for your actions. First of all there were 2 civilian witness' who weren't Dearborn residents that reported you were harrassing them and then disobeyed a stop sign in front of me and them. (They testified to such under oath in court). You refused any sobriety tests, you refused the breath test and I had to obtain a warrant from a judge for your blood. The blood results were twice the legal limit of alcohol in your system. As I recall you did not have a job at the time of the arrest. You stated that you were collecting disablity for a hurt knee and could not work. At first you plead to the charges but later recanted when you did not like the punishment. You had your day in court and were found guilty due to civilian witness', blood evidence and video evidence. You have no one to blame but yourself!

and prosecutors never lie? My son was pulled over 38 times in one summer in Canton. No tickets were written. Always the same, hey kid, you didn't come to a complete stop. How much you been drinkin? C'mon, tell us, we'll go easy on you. Can we search your car? If you have nothing to hide, why not? I know a young girl that got pulled over and groped in livonia, said they though she put drugs in her shirt. No arrest, no ticket. The cops are almost as bad as the bad guys anymore. It's all about the money. You sound like a cop. How many good decent folks have you pulled over for a minor traffic infraction and found out they had had a few beers and ruined their life with a dui arrest at .09 or .1? I don't know how some of you sleep at night.

It's real hard to tell the good guys from the bad guys anymore, just too much money in it. The mad muthas make a fortune off of so called drunk drivers, most of which are not a hazard to anyone. The state makes a bunch, the cops make a bunch and then the ins co's whack you. After all this there are the illegal fees jenny charges you. There, we will ask for a FULL repeal for the driver responsibility act. We will then ask for recall petitions for each of the senate, reps, and gov. who voted for this legislation in 2003, and the current supporters and the public survants who have no oppinion. How can it be, that the people are so unknowing. Once again, there are moe than trees in the forest. There are predators in them thar woods.
This is not a law. This is a distibution of power. The power is taken from the citizen, and given to a third party. This law was not put to a vote. More like an accord, Savvy? The SOS was looking for a way to provide revenue to the state. When the management falls down, the blame, or penalty is put on the worker. The powers at be decided tha since they have made bad decisions, both in industry and money cash distribution. That their bad judgement must be reconciled by the people. After all, we are the ones who elected them. Now the SOS is generating a huge amount of income for the state. And she is being held in high reguard. When a state is 9 billion dollars in debt, it is not a deficit. It is bankrupt! And who is gonna pull us out of bankruptcy? We are. Who else? The legislators, and the govorner are reaching into our pockets to keep them in their SUV's. Unfortunately for them, I used my lint in trade for toothepaste and a cookie. Nothing left in there. Look somewhere else!

Michigan is sucking the life out of its citizens. The fines they charge are absolutely ridiculous. I know so many people who dont have a drivers license. They did what the court told them to do, went to all the classes paid all the fines and still cant get their license cause Michigan wont give it to them. Why is this, how are people supposed to live without a car??? How are you supposed to go to work. Oh maybe they are to stupid to figure you need a license to work, duh. I dont remember voting this law in do you???

I used to be proud to live in Michigan. We have the Great Lakes, and we were part of the north that helped the slaves escape from the south. W
e are the state that started the automobile industry, and we have had a rich tradition of being a great place to vacation in the summer time. Now we are living in a hell hole. We let our politicians destroy our livelihoods with unfair free trade agreements. We let our governments continue to pass more and more laws that suppress our free rights more every single day! We are no longer the home of the free and the brave. We are the home of the oppressed, and the meek!

Michigan has become a cesspool of a state for it's citizens. We don't need more laws and fines, we need less, lots less. We spend about 2 billion a year on incarcerating prisoners, and I assure you it will go up! We don't need police giving tickets for no proof of insurance! Hell, the proof should be part of the state records system! There is NO reason to have to carry a vehicle registration or proof of insurance in your car! You have to show proof of insurance to get your registration at the secretary of state! This is the most bogus law ever eneacted! Just another stupid law to suck money from law abiding citizens! Seat belt laws are equally stupid! I'd be okay if they issued a ten dollar fine, and absolutely no driver responsibility fees for that infraction. If you are so stupid that you do not realize that the seatbelt will save your life, then you may deserve a tap on the wrist, but not a huge fine!! That can destroy your life!

Both our state and federal governments are responsible for the decline of Michigan and our country. Open borders, unfair freetrade agreements, massive taxes on everything, declining wages....and yet, these idiots in Lansing think we can afford to be fined two or three times for the same traffic violation? This is so unConstitutional that it almost is on par with the unPatriotic act! The culprit here is not the government. The reason we have gas at 4 bucks is because the tree huggers won't let the oil companies drill or refine. Here's a good question for all the government educated...If you choke of supply and demand stays the same, what do you think will happen to the price? it ain't the oil companies fault. They run on about a 10% profit margin. The state makes lots more on a gallon of fuel than the oil companies. Don't believe all the liberal pablum you've been fed. The world isn't going to burn up, the ice caps are growing, greenland was once green and is now covered with 25 feet of ice, drilling for oil does not hurt anything and after the Alaskan pipeline was put in the caribou herd size exploded.

At which time, we fill out the Recall proposals for all the legislators, the Secretary of State, and the governor for helping develop, and pass this law. Sometimes, the frog leaps before he's cooked.

Remember the story about the frog and the pot of boiling water? So long as you raise the water temperature gradually, Mr. Frog doesn't notice the increasing temperature until it's too late too get away.

The analogy is used to convey, in easy-to-understand language, the process of "government creep." We don't go from freedom to tyranny overnight; statism sneaks up on us incrementally, one step at a time. Each step, by itself, doesn't seem all that bad; just another annoyance to deal with or avoid if you can.

But one day you find yourself living in a country that looks more like Orwell's 1984 than the place envisioned by the authors of the Constitution and the Bill of Rights. Government -- its laws, its minions, its petty harassments and endless rigmarole -- is an omnipresence that is inescapable.

Which brings us to the matter of Virginia's "abuser fees," the brainchild of Republican state lawmaker Dave Albo.

Albo, who just happened to be a big-time lawyer connected with a firm that specializes in defending traffic cases, pushed for and got a new law that went into effect last July. It imposed unprecedented fines, as high as $3,000 per incident. These fines were charged to motorists for traffic infractions, including routine speeding, on top of whatever fine the court levied for the infraction.

The justification given was that the fees would help fund transportation improvements, and of course, "safety," that well-worn bray that's still remarkably effective, despite the obvious cynicism with which it is deployed.

But Albo and his backers made a mistake. They went for broke, and all at once.

Not only were the fines outrageously high relative to the offenses; not only did they constitute a "double tap," where violators paid, in effect, two fines; but to add insult to injury they only applied to in-state drivers.

A Virginia motorist convicted of driving 80-something mph on a Virginia highway with a posted speed limit of 65 mph faced a "reckless driving" charge, a court fine of several hundred dollars, plus an "abuser fee" of more than $1,000. But an out-of-state driver caught doing exactly the same thing only got the court fine.

Seem fair to you?


VIRGINIANS FELT THE same way. Lawmakers got an earful of a different sort of abuse. Several delegates who voted for the fees were turned out in the recent elections. Not even seven months after Albo's law went into effect, it is on the verge of being repealed in toto.

So the "abuser fees" will go, but it may be only a temporary victory. Albo and his friends will realize, if they haven't already, that they overplayed their hand. Gradualism is the key.

Next time, the "abuser fees" will only apply to indefensible acts -- DWI, vehicular manslaughter resulting from gross negligence, etc. Then, the law will be expanded to the next-down category of offenses -- things not quite so bad but still hard to make excuses for.

Few will complain. It will become accepted practice. Other states will pass similar laws. There will be uniformity, and reciprocity.

A few years will pass. Then, someone will propose that the fines be applied to yet more offenses. "Public safety!" will be the cry. And just as seat belt laws went from no-argument laws requiring that small children be restrained to "primary enforcement" laws that empower police to pull adults over for failing to "buckle up," so, too, will "abuser fees" eventually encompass routine and purely technical infractions, such as simple speeding.

And we'll have come full circle.

There's just too much money at stake; too much potential control over the masses to be passed up for long.

To paraphrase Arnold: They'll be back. Count on it.

And next time, we will probably not notice the water's getting warm again; at least, not before it's too late to jump.

Sorry, nothing has happened to speed the repeal of the Driver Responsibility Act. The Governor and your legislators still don't care whether you have a driver license, a job, or a home in Michigan.

By contract, the Governor of Virginia had his mind forcibly changed on this law by the voters of that state, and called in his State-of-the-State speech for its early repeal.

Michigan Democratic legislators are obviously still under orders from the Governor not to take up the bills to repeal this law, in order to protect the revenue flowing into the General Fund.

It's a mystery why Republican senators have not acted on the repeal, since they could easily make the Democrats look bad on this issue. But they like the money, too, and perhaps campaign contributions flowing from the collection agencies that profit from this program are involved.

first off, f&*k the state of michigan, f&*k them dead in their ear! maybe then they will listen. This law has hurt more people than anyone will ever realize. I moved to arizona over 2 years ago. Relinquished my state citizenship by obtaining an Arizona state id, and yes i said state id, because michigan stole my driving privileges, flat out stole them, but on to my point. I am a resident of the state of arizona, registered to vote here, have an address and bills coming to my house in my name, so id say i have pretty much established residency here. But for some odd reason i am still required to pay a reinstatment fee to a state that i no longer live in, and that i will not be renewing my license in. My license is suspended currently in the state of michigan for failure to pay my driver responsibility fee. Mind you, i have never had a dui, possession of drugs, an accident, a speeding ticket, reckless driving, none of em. I got hit for a seatbelt ticket and no proof of insurance. i had insurance and showed proof to the court yet i still have to pay a d.r.f. regardless of the fact that i was not guilty. My license has been suspended for going on 3 years now, and will probably remain suspended for some time because i have refused and will continue to refuse to let this state rip me off. I am half tempted to come back to michigan and get residency back, and file for welfare. Once i get said welfare i will promptly move back to arizona and obtain student residency, which is effectively dual residency in both michigan and arizona. Then i just sit and collect all my michigan welfare checks and reside in the beautiful sunny state of arizona. Lets see how the lawmakers react when i send them an itemized breakdown of how much money i have bilked from them over the years in welfare. I bet their tunes would change when they see that just because they got greedy and wanted to flat out rip off the residents of the state of michigan, that a citizen figured out a way to get over on them and reap 40 or 50 thousand dollars in welfare, all because they wanted to steal 1000 dollars from me. i bet they would shove their heads up their own rose smelling asses. I cant believe this! My wife goes to renew her licence and is told the "system is down" This is on a thursday. Goes back Friday same thing. Her birthday is on saturday. Grendmole about another 300 dollars we have to pay! I am trying to pay all my bills right now with little money as it is. I work 60-70hrs a week and go to school another 20 on top of that how the hell am i supposed to come up with the extra $300 for a bull crap fee? Were was the Gov. When i was injured at work? How about when i lost my job? how about were the hell is everyones money going? I see it going to losers driving escalades to get there food stamps thats were its going! I agree with you. My son has left the state due to this travesty. The typical driver is a young man or woman, fairly new driver stopped just for those 2 reasons. Scared out of their wits, can't find the insurance card, can't find the registration, etc. Given a ticket, scared to tell their parents or just too immature to know that they must respond to the citation.So the State continues to stack more fees on top of the original fee. My son has tickets for a variety offenses. None for drinking, none for speeding. High tech lighting, tinted windows no proof of insurance. His vehicle was never uninsured, just couldn't locate the proof. 22 yrs old with $6500 in fees for 4 unpaid tickets.

Although the Driver Responsibility Act was originally a Republican bill, it is being preserved entirely by Michigan Democrats. When the House Transportation Committee held a hearing on Rep. Scott's bill to reduce (but not repeal) the fees, Rep. Scott said that she would much rather repeal the fees than halve them, but that she had been told by "higher powers" that no repeal bill would ever pass.

Now, who is in a position to give orders to House Democrats? Not the voters. Not the NAACP, who testified movingly at the hearing against the fees. Clearly this can only mean the House's Democratic leadership and one other person, and she's a Democrat, too.

I predict this fee will not be repealed as long as the Democrats control one house and the governorship. They want the money, and they don't care how they get it.

Years from now, the only enduring legacy of the Granholm administration will be the $1,200 traffic ticket, and 100,000 Michigan drivers without driver's licenses.

Lawyers have a nice racket going with these bad drivers fees. If you plead guilty in a court and then the state sends you a bad driver fee notice. You have the option of going back and retracting you guilty plea in the court.

Now! You may have already payed a fine for this traffic ticket in the court, now you got to pay a lawyer to handle your court case again. Only to have to pay the court again for the ticket you payed the court for in the first place!

1) Went to court, payed a fine
2) Payed a bad driver fee to the state
3) Hired lawyer to change your plea
4) The bad driver fee is unconstitutional!
5) Try to find a lawyer who will take this type of case impossible!
6) Why? Its a lawyers bread and butter!Nice scam by lawyers.
7) SO FILE YOUR OWN FEDERAL LAWSUIT PEOPLE! TAKE THE LAW INTO YOUR OWN HANDS BECAUSE NOBODY ELSE IS GOING TO DO IT.

wheater you may agree with this DRF or not, ask yourself this question. Looking at the law for what it is, would you be in agreement on a law that says, "once you pay your fine, you pay your fine again!?!? Sounds like the craziest thing in the world, don"t it. And then you say to yourself, "man, as soon as this thing gets on the ballot, put me down for a big no". Oh, wait, state reps. passed this "TAX" without giving you the right as a tax paying citizen of this great state to vote on this. Kinda like, they knew we would say no on this one. But when you have buisnesses leaving the state, economy in the toilet, I guess you look for ways to generate revenue. Even if it is wrong.
Say you get popped for this, license suspended. You pay and state says that it is unpaid (happenes more than you would believe) and license remaines under suspension. Now, you are a man with wife and children that you have to support. Are what are you going to do? Cant always get a ride work and we dont have subways. Are you going to illegally drive to work in the name of supporting your family? In this instance, do the ends justify the means?

I was first informed of the driver responsibility fee after I was convicted of driving on a suspended license (for refusing to wear a seatbelt which i still refuse to wear today, but that's a different battle). I was totally taken by surprise with this as this was simply assessed and a letter was sent to me telling me pay up or else I'd never see my license again. Further I was informed I wouldn't be punished twice, but three times! once by the court, twice by the state. I was assessed 3 driver responsibility fees totalling $1500.00. I'm a diabled veteran who served both my federal and state govenment honorably for many years. I now live on $880.00 per month. Needless to say I cannot pay such an insane repeated punishment. Two weeks ago the police came to my door with a warrant for my arrest in the middle of the night (a nazi tactic). They took me to Grand Haven, around 20 miles away, and forced me to ransom myself back for $178.00. I was then escorted out the door into 30 degree weather with no coat to walk 20 miles back home where I proceeded to have a mental meltdown and almost killed myself after realizing that no place in this world is safe from these "home bred terrorists". I also found that while I was walking home they used this arrest to get a warrant, break in my door and ransack my house ant took everything of value, meaning my computer and expensive digital camera, and all my copyrighted digital photography looking for kiddy porn that I have no interest in. To this day I wonder what they are putting on my computer to charge me with next. Not only do I think that this driver responsibility fee should be repealed, but the state of michigan should also be monetarily punished for doing wrong as they punish us for doing wrong. I also think the cops have way more power than they need to do whatever they want and that power should be taken away since they abuse it regularly.

Remember this people! You can filke your own Pro Se lawsuit against the State of Michigan. You can go on-line and down load the forms or you can go to your federal court house and pick up a Pro Se packet. Fill out the appropriate form, in this case it would be: Civil Rights Complaint Pursuant to 42 U.S.C. 1983.

After you've filled out this form and stated the facts and the constitutional violations, Like no due process, which is a 14th Amendment violation, or 5th Amendment, double jeopapardy, being penalized again for the same traffic offence.

Then either mail it or file it with the filing fee back to the federal cleks office for processing.

Or enough of you can get together somewere and file your own class action lawsuit against the State of Michigan.

And to hell with the lawyers, this is their bread and butter. Not one is going to help you file this lawsuit because you will win and this Driver Assesssment will be come unconstitutional and stricken from the books.

Also you have 3 years from the time that these fines and penalties were illegally impose on you to file this federal lawsuit. So it doesn't matter if you fined back in November of 2004 you can still file a lawsuit, but you hade better hurry! You three year time limit to file this federal lawsuit will expire...

I am 43 and lost my license in '87. I live in a small town that has no type of public transportation. The county wanted their money and the only way i had to pay them was to continue to drive and naturally i was caught driving. This was a revolving door situation, until i had enough that i was charged and convicted of habitual motor offender. I was sentenced to 4 years in the pen and was told that all my court costs and fines would be nollied because i flattened my time. When i was released i began to inquire about getting them back. I found out that the court and the judge turned all my past judgements over to a collection agency. Now i have to pay this agency off before the state of tennessee will even think about reinstating my license. All my costs should be squashed because i served day for day on each charge i was sentenced. I feel that the state should help people in my situation because if the law would've been the way it is now i know i would've never got the 2nd d.u.i.

In the next 5 years michigan will become a penal colony. Michigan now has more jails/prisons than any state in the counrty. If laws like the Drivers Responsibility Act aren't repealed there will be no honest hard working citizens left in the state. All of our carpenters, tool makers, auto designers and dentists will leave. Everyone needs to do somthing about this, or nothing will ever change. The Lansing government will hold all the power because we "decided" to do nothing.

Do you want to live in constant fear of your next fine from state government for breaking a simple trafic law (misdemeaner) and pay felons punishment? Or do you think this should be a free and fair country the way our founding fathers intened it? Really "WE THE PEOPLE" only pertains if the people get involed and watch what our government is doing. This is about revenue.

Breaking trafic law that could cost you the right to drive , which in turn will cost you your job and home.
Not having a proof of insurance is a clerical mistake in most cases. A burned out brake light is a maintenance issue. DRA means $1100 extra.
Let your legislater know what you think, BE INFORMED. House bill 4006 repeals this unfair "tax-law".

SAVE OUR GREAT STATE before its too late and we are all felons.

A federal lawsuit is about to be filed in New York State against the New York State Department of Motor Vehicles, Driver Responsibility Assessment Program. What the New York State DMV is doing is taking a traffic ticket after a person has already been before the court and had that ticket discharged.

The New York State DMV takes that same ticket, and adds points to it. Thats right! Adds points to it and sends out a Driver Responsibility Assessment Statement, informing the person that they have points on their driving record, and because of these points the must pay another fine or thier driver licesne will be suspended.

New York State DMV has violated the 5th Amendment, 8th Amendment, 14th Amendment under color of law! Look up the term color of law!

It is also FRAUD AND CONTEMPT OF COURT! Altering a courts decision...

Well if this lawsuit against the New York State DMV is won. Then it will effect everyone else in other states because this is a federal issue, not a state so this lawsuit can be used in Michigan and Texas.

I am sure in Nazi Germany when the gestapos told the citizens not to drive their cars in 1939 some people said,'try and stop me'. These folks drove to Austria and Poland to be free again.

That is what the Granholm administration is trying to attempt here. The state will not issue license plates or personal drivers license because the state is broke and the loonies in Lansing think they can extort cash from the working man. These fees are not fines. They are blackmail pure and simple. Pay to help the state's bankrupcy or be a criminal. I spoke with
a twenty year old waiter with no proof of insurance and the DR fee alone was $1000. This man can only earn that in a month and he has 3 kids to feed. Do the math. Is he going to let his kids starve or drive without legal status. It takes guts to live in Michigan.

So, the SOS will suspend their license for not paying, they will drive anyway, get into another accident or have another drunk driving incident, rack up more points, more driver responsiblity fees, and just keep driving. All this does is force those people to drive anyway instead of be law abiding. Drop the fee and find another way to help those folks be responsible.

In Nov. of 2005 I got a DUI. I admit that I had a few beers at the restaurant and I know I probably shouldn't have been driving. It was raining and when I turned the corner exiting the highway, my car slipped a little and I nearly hit a curb. It was cold out and I think the ice on the roads had a bit to do with it.
$2000 for the lawyer. $2000 in fines in court. $1500 for the increase in insurance (I'm 32 and this was my very first ticket). Year 1, $1000 for a driver responsibility fee. Year 2, $1000 for a driver responsibility fee. I missed my July payment this year. We just don't have the money. Then in August, I receive a letter stating that I have until August 29th to resolve the payment missed or they will suspend my license. I had just deposited the check to pay the fine online via EFT yesterday. Then last night we log in to HIS bank account to pay a few bills. "I AM NOT ON THE ACCOUNT" only to find that they have frozen the account and placed a levy against the $370 in it. This morning we find three bounced checks and $75 in fines for those.
Looks like we are headed straight down into a pit of financial trouble over this and we have no idea what to do.
Can they freeze his account for my driver responsibility fee?
Why didn't they send some type of notice that they were going to do this?

You need to accept responsibility for your actions, pay your fines. You knew you had to make this payment and chose not to - once again, you appear to have not learned from your mistake. Plan ahead financially - you know you have to pay your mortgage each month and you plan for it. You can't tell the bank, 'sorry, money is tight' - you are still responsible for what you owe. By the sounds of your letter, you have no remorse for what you did, you are still blaming it on the weather. You were driving drunk - don't feel sorry for yourself that you are now facing the music for your actions, take responsibility for what you did, don't ever make the same mistake again and realize you are lucky you or someone else weren't more seriously injured. Take a cab the next time and stay off our roads!

I am all for responsibility. Every punishment should fit the crime. If punishment is too lenient legislature can increase penalties. It is right to apply severe penalty for severe crime.
It is also against a law of this land to punish two or more times for the same crime. Unfortunately Michigan Driver Responsibility Law clearly violates Double Jeopardy clause in 5-th Amendment to the Constitution
It doesn’t matter what you call it. Legislators call it “fee”. The “fee” results from previous judgments and is not voluntary. It doesn’t matter that “fee” relates to a group of previous offences. It serves as an extension of previously settled punishments. So in fact it is a second or third punishment for whatever was a source of assessment points within a fraction of the “fee”. I am not a lawyer and I can see it – how come legislators of whom most are lawyers and/or have lawyers on their staffs fail to notice it.
The “fee” is not a fee. It is an extra penalty on violation cases already closed and concluded. It is common practice to charge and panelize different first time offenders than multiple offenders of the same crime. So this scenario already had been taken into consideration.
Obviously there is a problem with a motive of passing such a law. Public safety or interest doesn’t fit here. Does public benefit from sending lives of Michigan residents into financial corkscrew without a hope? What happened to a democratic justice principle of being able to pay a debt to the society for committed offence and to start anew?
Michigan Drivers responsibility law takes away a hope from life of many residents, and for many the crime doesn’t fit punishment. Crimes vary in their weight. Driving without insurance because one can’t afford it is nor as serious as drunk driving and having accident as a result.
So what’s the motive? Obviously – money. State needs it – but who doesn’t? Obviously those who are least able to defend themselves, and are in highest in numbers, once more fall a victim to yet another sham to funnel money to state. Hiding behind false labels legislators are attempting to shift a weight of state funding to those less fortunate. I didn’t forget a fact that former governor, John Engler, with republican than legislature was generous to spend state surplus money on tax refunds to those that need them least. In a climate of already slipping economy this put instantly the state budget in jeopardy. New legislature instead to get reality check and too deal with a problem of budget cowardly passes a buck to mostly working poor people.
Coming back to idea of responsibility I really would like to start a grass roots drive to pass a law that lawmakers will be responsible financially and criminally for actions they take. If you introduced and/or voted for the bill that would cause a loss of jobs without first creating replacement jobs than you should be punished. If you introduced and/or voted for a budget that is not balanced in reality not only on a paper than you should be punished.

Noone is saying that we're not responsible for the actions we performed. The complaint is that we did something stupid and that we're being severely overtaxed/overpunished for those actions. i had to pay over $3000 for my fee's. Over 3 tickets in Walker that cost me $988 already. One fee of $500 should be more than enough. But telling us we have to may more per offense plus an extra 200 for this crap per year? thats unfair

Could have shouldn't be illegal. If someone damages you or your property then there is a crime. Everyone of us has the potential to do harm everyday. I'll bet you drive around with a cell phone glued to your ear all day. It is a proven fact that a driver on a cell phone is as bad or worse than a .01 drinker. Do you support ruining your life for talking on a cell phone? The only difference is the media campaign to demonize alcohol.

Do you think for one minute they will listen to the people? St. Clair County recently voted against the 800 mhz radio system that would have increased the taxes. Remember the citizens voted it down. Well you guessed it they are going in crease your tax and do it any way. The same thing happened in Macomb County a few years ago. People its time to have another tea party.
