Introduced by Rep. Steve Tobocman (D) on September 21, 2005, to give local governments the power to impose a new zoning classification on property that does not conform to the classification after a period of “amortization,” which is not defined in this statute. This statute gives local governments the power to order a nonconforming structure or use to be removed, and to use the power of eminent domain to take nonconforming property.

We do not want local governments to be able to seize private property, except in the most extreme circumstances. Reply
