Introduced by Rep. David Robertson (R) on March 23, 2005, to establish graduated penalties for those who are seriously delinquent in making child support payments. The highest penalty would be up to 10 years in prison and a $15,000 fine, or triple the amount of unpaid child support, for a person who owes more than $20,000 or has failed to pay for five years or more. The lowest penalty would be up to 90 days in jail and a $2,000 fine, or triple the amount of unpaid child support, for a person who owes more than $1,000 or has failed to pay for 90 days or less. Prior convictions could also qualify a violator for the enhanced penalties.
