Introduced by Rep. Andrew Richner (R) on January 25, 2001, to allow hearsay evidence, in the form of a signed affidavit from the complaining witness, at a preliminary exam. This signed affidavit would thus be acceptable as a substitute for the appearance and testimony of the complaining witness at the preliminary exam only. The defendant would retain the right to face the accuser when and if the case proceeded to an actual trial.
