2008 Senate Bill 1312

Revise protected individual asset protection orders

Introduced in the Senate

May 13, 2008

Introduced by Sen. Jason Allen (R-37)

To allow a local law enforcement officer or the director of the local government social services agency who has a “good faith belief” that a “protected individual’s” (an orphan, “incapacitated individual,” vulnerable adult, etc.) assets or estate are in danger of being dissipated, to petition a court to issue a protection order. Under current law, only a parent, guardian, custodian or other person with an actual interest in the property may seek such an order.
